Important Notice
These Terms of Service constitute a legally binding agreement between you and Simarahitam Technologies Pvt. Ltd. By using SimaraGuard, you acknowledge that you have read, understood, and agree to be bound by these terms.
Summary
Here's what you need to know:
- Chrome Extension Only: SimaraGuard operates exclusively as a Chrome extension for LinkedIn analysis.
- Platform Dependency: The extension relies on LinkedIn's website structure. LinkedIn changes may cause temporary service interruptions until we release updates.
- Your Data, Your Control: You own all your content. We never sell it or use it to train AI models.
- Security First: All data is encrypted in transit (TLS) and at rest in our secure database.
- AI Processing: We use third-party LLM providers to analyze your content.
- No Training: We DO NOT train AI models on your personal data. Ever.
- Your Rights: Access, modify, export, or delete your data anytime (GDPR & DPDP Act compliant).
- No Refunds: All subscriptions and credit purchases are non-refundable, including service interruptions due to LinkedIn platform changes.
- India Jurisdiction: Governed by laws of India, courts of Bangalore, Karnataka.
- Data Archival: 15 days post-subscription expiry, we may archive your data.
1. Introduction & Acceptance
By using SimaraGuard, you agree to these Terms of Service. You must be at least 13 years old to use this service.
SimaraGuard is owned and operated by Simarahitam Technologies Pvt. Ltd., a company registered in India.
2. Service Description
SimaraGuard is an AI-powered LinkedIn content analysis tool delivered via Chrome extension that helps you:
- Analyze LinkedIn content for tone, safety, and potential risks before posting
- Receive AI-powered content analysis and improvement suggestions
- Make informed decisions about your LinkedIn posts and comments
The Service is provided on a subscription basis, with pricing available at simaraguard.com/pricing.
2.1 Chrome Extension Dependency & Limitations
IMPORTANT - Platform Dependency Notice:
- DOM Structure Dependency: The SimaraGuard Chrome extension operates by integrating with LinkedIn's user interface through its Document Object Model (DOM) structure
- Platform Changes: LinkedIn may change, update, or modify its website structure, design, or functionality at any time without notice
- Service Interruptions: Any changes to LinkedIn's DOM structure may cause the Chrome extension to temporarily or permanently cease functioning until we release an update
- Update Timeline: While we strive to maintain compatibility and release updates promptly, we cannot guarantee specific timelines for addressing platform changes
- Service Outages: You acknowledge and accept that the extension may experience periods of unavailability or reduced functionality due to LinkedIn platform changes
- No Liability: SimaraGuard is not liable for any service disruption, data loss, or inability to use the extension caused by changes to LinkedIn's platform structure
- No Refunds: Service interruptions caused by LinkedIn platform changes do not entitle users to refunds or service credits
- Best Efforts: We will make commercially reasonable efforts to monitor LinkedIn changes and update the extension to maintain compatibility
3. Data Collection & Usage
3.1 What We Collect
- Account info (email, name, profile)
- Content you submit for analysis
- Social media OAuth tokens (securely stored)
- Posting decisions and analysis history
- Payment information (processed by third-party payment processors)
- Usage statistics (anonymized)
3.2 How We Use It
- To provide AI-powered content analysis
- To post content on your behalf (only when you explicitly choose to publish)
- To track your posting decisions and send email notifications
- To process payments and manage subscriptions
- To improve the service
- To comply with legal obligations
3.3 What We DON'T Do
- We DO NOT train AI models on your data
- We DO NOT sell your data
- We DO NOT share data with advertisers
- We DO NOT use your data beyond stated purposes
4. Data Security & Encryption
4.1 In Transit
- TLS encryption for all communications between client and server
- Secure HTTPS connections
- Industry-standard security protocols
4.2 At Rest
- Database encryption via Google Cloud Firestore
- OAuth tokens securely stored and encrypted
- Automatic backups and redundancy
- Access controls and authentication
4.3 Data Breach Notification
In the event of a data breach involving personal data:
- We will notify the Data Protection Board of India within 72 hours of becoming aware
- We will notify affected users within 24 hours via email
- Notification will include: nature of breach, data affected, remedial actions, and contact information
5. AI Processing & Third-Party Services
5.1 AI Providers
We use third-party LLM providers to power AI-driven content analysis and recommendations.
5.2 Data Sent to AI
- Your content submitted for analysis
- Platform selection (X/Twitter or LinkedIn)
- Intended tone preference
5.3 Important Notes
- We DO NOT use your data to train AI models
- AI providers process data per their privacy policies
- Data is only sent when you request content analysis
- We cannot guarantee AI provider data retention policies
5.4 User Responsibility for Third-Party AI Data
IMPORTANT - Third-Party AI Data Processing:
- User Responsibility: You are solely responsible for any data or content you provide to SimaraGuard that is transmitted to third-party AI models
- No Control Over AI Providers: SimaraGuard does not control how third-party AI model providers process, store, or utilize data transmitted to their systems
- No Guarantees: We make no guarantees or warranties regarding how third-party AI providers handle your data, including retention policies, usage policies, or security measures
- Limited Governance Scope: SimaraGuard's data governance and protection commitments apply exclusively to data saved within our platform's secure database. Data transmitted to third-party AI providers is subject to their respective terms and privacy policies
- No Liability: SimaraGuard is not responsible or liable for any use, misuse, disclosure, or breach of data by third-party AI providers
- Informed Consent: By using AI-powered analysis features, you acknowledge and consent to the transmission of your content to third-party AI services and accept the associated risks
5.5 AI Disclaimer & Liability
IMPORTANT - AI Limitations:
- AI analysis is for informational purposes only
- We do not guarantee accuracy, completeness, or reliability of AI-generated content
- AI is not a replacement for human judgment or professional advice
- AI may produce biased, incorrect, or outdated information
Liability Limitation:
- We are NOT liable for decisions made based on AI recommendations
- We are NOT responsible for errors, omissions, or harm resulting from AI-generated content
- Users are solely responsible for verifying AI outputs and making informed decisions
- You remain responsible for all content posted to your social media accounts
6. Data Retention & Deletion
6.1 Active Subscriptions
- Content analysis history: Retained while account is active
- Posting decision records: Retained while account is active
- Social media OAuth tokens: Retained until you disconnect accounts
- Usage logs: 90 days
- Payment records: 7 years (legal requirement)
6.2 Subscription Expiry & Data Archival
When your subscription expires:
- Immediate: Access to premium features (content analysis, posting) is disabled
- 15 Days Post-Expiry: We may archive your user data and automatically disconnect connected social media accounts
- Data in Archive: Archived data can be recovered upon subscription renewal within a reasonable timeframe
- Payment Records Exception: Payment transaction records are retained for 7 years as required by law, regardless of subscription status
6.3 Account Deletion
If you explicitly request account deletion:
- Immediate: Social media accounts are disconnected
- Soft delete: 30-day recovery period
- Permanent deletion: After 30 days, all data deleted from active systems
- No recovery: Data cannot be recovered after permanent deletion
- Payment records retained: Payment transaction records remain for 7 years (legal requirement)
6.4 What's Deleted
- Account credentials
- All content analysis history
- Posting decision records
- Social media OAuth tokens
- Profile information
6.5 What's Retained
- Payment transaction records (7 years - legal requirement)
- Anonymized analytics (no personally identifiable information)
7. User Rights & Data Access (GDPR & DPDP Compliant)
7.1 Your Rights
You have the right to:
- Access your data
- Rectify inaccurate data
- Erase your data (right to be forgotten)
- Export your data (JSON format)
- Disconnect social media accounts at any time
- Cancel your subscription at any time

8. Subscription & Payments
8.1 Plans
- FREE: 25 checks, 5 posts per month
- STARTER: 100 checks, 20 posts per month
- PRO: 250 checks, 50 posts per month
- PROFESSIONAL: 500 checks, 100 posts per month (monthly or annual)
- PRO PLUS: 1000 checks, 200 posts per month (monthly or annual)
8.2 Pricing
- Available in INR (₹) and USD ($)
- INR prices include GST (18%)

8.3 Payment Processing
- Processed by third-party payment processors (PCI DSS compliant)
- We don't store credit card numbers
- Supports UPI, cards, net banking, and wallets
8.4 Subscription Upgrades
- When upgrading, remaining credits from your current plan are added to the new plan limits
- Upgrades are processed immediately upon payment
- Downgrades are not supported at this time
8.5 Cancellation & Refunds
- No refunds: All subscriptions and credit purchases are non-refundable
- Cancel anytime (access continues until end of current billing period)
- No refunds for partial periods or unused credits

9. Social Media Connections
When you connect your social media accounts:
- You authorize SimaraGuard to post on your behalf only when you explicitly choose to publish
- You can disconnect accounts at any time from your account settings
- We use third-party API services for social media OAuth authentication and posting
- Your social media OAuth authorization tokens are stored with third-party API providers, not on our servers
- You remain solely responsible for content posted to your social media accounts
- Disconnected accounts' tokens are immediately revoked from the third-party API provider
10. Acceptable Use
You agree NOT to use SimaraGuard to:
- Analyze or post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity
- Post spam or repetitive content
- Violate intellectual property rights
- Attempt to gain unauthorized access to the Service or connected social media accounts
- Reverse engineer or decompile the Service
- Use automated systems to access the Service without permission
Violations may result in account termination.
11. Content and Intellectual Property
11.1 Your Content
You retain all rights to content you submit to SimaraGuard. By submitting content, you grant us a limited license to:
- Analyze your content using AI models
- Store your content and analysis results
- Improve our Service quality (in anonymized form only)
11.2 Our Content
The Service, including its design, features, and functionality, is owned by Simarahitam Technologies Pvt. Ltd. and protected by copyright, trademark, and other intellectual property laws.
12. Service Availability
We strive for high uptime but don't guarantee:
- Uninterrupted access
- Error-free operation
- Compatibility with all devices
12.1 Force Majeure & Service Unavailability
SimaraGuard shall not be liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to:
- Third-Party Service Failures: Outages, disruptions, or discontinuation of third-party AI providers, cloud infrastructure, payment gateways, social media platforms (LinkedIn), or other essential services
- LinkedIn Platform Changes: Changes to LinkedIn's website structure, DOM, API, design, or functionality that render the Chrome extension temporarily or permanently incompatible
- Technical Failures: Server failures, network outages, database corruption, security breaches, DDoS attacks, or other technical issues
- Natural Disasters & Acts of God: Earthquakes, floods, fires, pandemics, epidemics, or other natural calamities
- Government Actions: Changes in law, government regulations, court orders, sanctions, or internet shutdowns
- Labor Disputes: Strikes, lockouts, or other industrial actions
- Financial Constraints: Inability to continue operations due to financial insolvency or business closure
In the Event of Service Unavailability:
- Notification: We will make reasonable efforts to notify users via email or website about service disruptions
- Best Efforts: We will use commercially reasonable efforts to restore services as quickly as possible
- No Refunds for Force Majeure: No refunds will be provided for service unavailability due to force majeure events
- Data Preservation: We will make reasonable efforts to preserve user data during force majeure events, but cannot guarantee data integrity in all circumstances
13. Limitation of Liability
IMPORTANT: Service provided "AS IS" without warranties.
13.1 We are NOT liable for:
- Indirect, consequential, or punitive damages
- Loss of profits, data, or business
- Inaccurate, misleading, or harmful AI recommendations
- Decisions made based on AI-generated content
- Content posted to social media based on AI analysis
- Data loss due to user error
- Third-party service issues (including AI providers, social media platforms)
- AI errors, biases, hallucinations, or omissions
13.2 Maximum Liability
Amount you paid in last 12 months or ₹10,000, whichever is less.
14. Indemnification
You agree to indemnify SimaraGuard from claims arising from:
- Your use of the service
- Violation of these Terms
- Violation of third-party rights
- Your content or posts made to social media
- Decisions made based on AI-generated content
15. International Data Transfers
15.1 Data Storage
- Primary Data Center: Secure cloud infrastructure
- AI Processing: International - Third-party LLM providers (location varies by provider)
- Social Media Tokens: Stored with third-party API service providers
15.2 Cross-Border Transfers
- All transfers encrypted in transit
- GDPR & DPDP Act compliant
16. Children's Privacy
Service is intended for users 13 years and older. We don't knowingly collect data from children under 13. If you believe we have collected data from a child under 13, please contact us immediately.
17. Termination
17.1 By You
- Delete account anytime through settings or by contacting support
- Social media accounts disconnected immediately
- Data deletion after 30-day soft delete period
17.2 By Us
- For Terms violations
- For illegal activity
- For abusive use of the Service
- For non-payment
18. Dispute Resolution & Jurisdiction
18.1 Governing Law
- Governed by laws of India
- Jurisdiction: Courts of Bangalore, Karnataka, India
18.2 Resolution Process
- Informal resolution (30 days) - Contact support@simaraguard.com
- Mediation (if needed)
- Binding arbitration (Arbitration and Conciliation Act, 1996)
- Litigation - Exclusive jurisdiction: Courts of Bangalore, Karnataka, India
19. Changes to Terms
Material changes notified 30 days in advance via:
- Email notification
- In-app notification
- Website announcement
Continued use = acceptance of changes.
